日本国憲法のこと About The Constitution of Japan

 　日本には、素晴らしい憲法がある。1947年5月3日に施行された、日本の最高法規である。

　しかし今、自由民主党という日本の政権政党により、その憲法が無力化させられようとしている。自民党のトップである高市首相は、アメリカに行ってトランプと会い、なんと彼に抱きついた。国家のトップが、何という恥ずかしいことをしでかしたのか。わたしは、驚いた。

　だが、高市のこれまでの発言からは、そうした行為は想像出来る。

　タレント時代の彼女は、ミニスカートをはいて、「女を押し倒せない男が増えている」などと公然と言い放った人物だ。そして彼女は、男性との身体接触が特徴だという。

　その彼女が、日本から売るものとしては車しかなくなった日本の産業界に、次は軍需品で儲けようと、殺傷兵器を海外に販売しようと画策している。

　しかし、日本には、平和憲法というものがある。

　その前文には、こういう記述がある。

 日本国民は、恒久の平和を念願し、人間相互の関係を支配する崇高な理想を深く自覚するのであつて、平和を愛する諸国民の公正と信義に信頼して、われらの安全と生存を保持しようと決意した。われらは、平和を維持し、専制と隷従、圧迫と偏狭を地上から永遠に除去しようと努めてゐる国際社会において、名誉ある地位を占めたいと思ふ。われらは、全世界の国民が、ひとしく恐怖と欠乏から免かれ、平和のうちに生存する権利を有することを確認する。

われらは、いづれの国家も、自国のことのみに専念して他国を無視してはならないのであつて、政治道徳の法則は、普遍的なものであり、この法則に従ふことは、自国の主権を維持し、他国と対等関係に立たうとする各国の責務であると信ずる。

日本国民は、国家の名誉にかけ、全力をあげてこの崇高な理想と目的を達成することを誓ふ。

　素晴らしい文言ではないか。

　そして第九条には、 

第9条　日本国民は、正義と秩序を基調とする国際平和を誠実に希求し、国権の発動たる戦争と、武力による威嚇又は武力の行使は、国際紛争を解決する手段としては、永久にこれを放棄する。

２　前項の目的を達するため、陸海空軍その他の戦力は、これを保持しない。国の交戦権は、これを認めない。 

　とある。

　第一次世界大戦で多くの戦死者がでたことから、国際社会は国際連盟を組織して、国際的に戦争を抛棄しようということを確認した。そして1928年には、不戦条約を締結した。

　しかし、残念ながら、再び第二次世界大戦が起きてしまった。その戦争が終結するその少し前、国際連合が組織され、戦争だけではなく、武力の行使をやめよう、という共通理解ができた。ところが、アメリカは、完成したばかりの原子爆弾を、日本の広島と長崎に投下した。一瞬、二つの都市が破壊され、そこにいた人びとは、瞬間的に消えてなくなったりして亡くなり、大やけどを負ったり、地獄の世界のなかに放出された。

　だからこそ、その後にできた日本国憲法は、先のような前文と第九条をつくった。軍隊は持たない、交戦権も認めない、というように。

　そうした憲法を持つ国の政権政党が、公然とそれを潰そうとしている。

　第二次世界大戦へとつながる時期、日本は軍隊を中国に派兵して、都市を破壊し、中国の人びとを殺戮し、毒ガスをつかい、強制的に連行し、労働を強制した。その中国との戦争に向けて、日本は中国に向けて、長距離ミサイルを配備しようとしている。政権政党が、アメリカの意向のもとに、率先して軍備拡大をしようとしているのだ。

　明日は、日本では憲法記念日である。平和憲法を守ろうという声が、日本各地であがることだろう。 

 Japan has a wonderful constitution. Enacted on May 3, 1947, it is the supreme law of the land.

However, right now, Japan’s ruling party, the Liberal Democratic Party (LDP), is attempting to render that constitution powerless. Prime Minister Takaichi, the head of the LDP, went to the United States to meet with Trump and, unbelievably, hugged him. What a shameful thing for the head of state to do. I was shocked.

　But given Takaichi’s past remarks, such behavior is not hard to imagine.

During her days as a TV personality, she wore miniskirts and openly declared things like, “There are more and more men who can’t push women down.” And she is known for her tendency toward physical contact with men.

That same woman is now plotting to profit from military goods—specifically, to sell lethal weapons overseas—to a Japanese industrial sector that has nothing left to sell but cars.

　However, Japan has a Peace Constitution.

The preamble contains the following passage:

We, the Japanese people, desire peace for all time and are deeply conscious of the high ideals controlling human relationship, and we have determined to preserve our security and existence, trusting in the justice and faith of the peace-loving peoples of the world.We desire to occupy an honored place in an international society striving for the preservation of peace, and the banishment of tyranny and slavery, oppression and intolerance for all time from the earth.We recognize that all peoples of the world have the right to live in peace, free from fear and want.

We believe that no nation is responsible to itself alone, but that laws of political morality are universal; and that obedience to such laws is incumbent upon all nations who would sustain their own sovereignty and justify their sovereign relationship with other nations.

We, the Japanese people, pledge our national honor to accomplish these high ideals and purposes with all our resources.

Isn’t that a wonderful phrase?

And Article 9 states, 

Article 9.　Aspiring sincerely to an international peace based on justice and order, the Japanese people forever renounce war as a sovereign right of the nation and the threat or use of force as means of settling international disputes.

In order to accomplish the aim of the preceding paragraph, land, sea, and air forces, as well as other war potential, will never be maintained.The right of belligerency of the state will not be recognized.

 

 Because World War I resulted in so many casualties, the international community formed the League of Nations and reaffirmed its commitment to renouncing war on an international level. Then, in 1928, the Kellogg-Briand Pact was signed.

However, unfortunately, World War II broke out once again. Shortly before that war ended, the United Nations was established, and a common understanding emerged to renounce not only war but also the use of force. Yet, the United States dropped the newly developed atomic bombs on Hiroshima and Nagasaki in Japan. In an instant, the two cities were destroyed; the people there were instantly vaporized or killed, suffered severe burns, or were cast into a living hell.

That is precisely why the Japanese Constitution, enacted afterward, included the Preamble and Article 9 described above—stating that Japan would not maintain armed forces and would not recognize the right to wage war.

 

Yet the ruling party of a country with such a constitution is openly trying to dismantle it.

During the period leading up to World War II, Japan dispatched its military to China, destroying cities, massacring the Chinese people, using poison gas, forcibly deporting people, and subjecting them to forced labor. Now, in preparation for a war with China, Japan is attempting to deploy long-range missiles aimed at China. The ruling party is taking the lead in expanding military capabilities under the direction of the United States.

Tomorrow is Constitution Day in Japan. Voices calling for the protection of the Peace Constitution will likely be heard across the country.
